Is Cannabis legal in Poland?

Medical marijuana was legalized in Poland in 2017 and recreational marijuana is illegal.

Poland is said to have some of the strictest regulations on marijuana in Europe, and possession of recreational marijuana is punishable by up to three years in prison.

However, possession of small amounts is said to carry many on-the-spot fines and other penalties.

As part of Poland’s “treat rather than punish” approach to cannabis regulation, those caught using or possessing recreational cannabis have the right to participate in treatment programs and are encouraged to actively participate.

According to a 2020 poll in Poland, 8% of Poles under the age of 34 have used recreational marijuana at least once in the past year.

There is currently no move to legalize recreational marijuana in Poland, but the movement of marijuana in European countries may lead to its legalization or decriminalization.

Medical marijuana in Poland

Medical marijuana must not contain more than 0.3% THC in the tops of non-fibrous flowers or berries from which the resin has not been extracted; the 0.3% THC content was recently raised to 0.2% until May 2022.

Medical marijuana was legalized in 2017, allowing medical marijuana products to be prescribed for any condition if treatment with medical marijuana is effective for the patient.

However, it did not become very popular due to supply and cost issues until a new law in 2022. The reason why medical marijuana did not become popular is related to the situation of marijuana production in Poland. Although medical marijuana was legalized, it could not be cultivated in Poland until 2022, and the country had to rely on imports for cannabis products. In addition, medical marijuana treatment was a burden for many people as they had to pay for the entire treatment.

In March 2022, a new law will be enacted to allow the cultivation and processing of cannabis for medical products in Poland, moving towards improving the medical marijuana problem.

Medical marijuana cannot be used in public places and must be used on private property or in secluded areas.

Cultivation Regulations

In Poland it is illegal for individuals to cultivate marijuana. Even for medical purposes, it is illegal to cultivate marijuana without an official license, and unauthorized cultivation is a serious offense.

The new law of 2022 abolishes the binding prohibition on the cultivation of cannabis and allows research institutions supervised by the Minister of Agriculture to cultivate cannabis for medical purposes if they obtain a license from the Chief Medical Inspector.

CBD products are legal

CBD products are legal in Poland.

However, there are some restrictions: the THC content must be less than 0.3%; if the THC content exceeds 0.3%, it is treated as cannabis and is illegal. It is also said that a license is required to sell CBD products.

However, Poland is also said to be one of the easiest countries to access CBD products. In the past, most CBD products were made in the Czech Republic, but recently there has been an increase in the number of Polish CBD products.

In Poland, CBD products can be purchased both online and in stores.

While many European countries have legalized or decriminalized recreational marijuana, recreational marijuana is still illegal in Poland. Therefore, you cannot bring cannabis into Poland.
